Chupian Terms of Use

These Terms form an agreement between you and AI CORTEX NEXUS LIMITED ("we" or the "Company") for the Chupian app, websites, and related services. By accepting, registering, signing in, or using the service, you agree to these Terms, the Chupian Privacy Policy, the Paid Services and Auto-Renewable Subscription Terms, and Apple's applicable terms. If you do not agree, do not use the service.
1. Service and agreement
Chupian provides AI photo retouching, local edits, object removal, output sizing, history, local saving, paid passes, subscriptions, credits, and support. Product notices and specific campaign rules form part of these Terms. We may update the Terms when the service or law changes. We will prominently notify you of a material change and obtain renewed consent where required.
2. Eligibility
You must have the legal capacity required in your location. Users under 18 should use Chupian under guardian supervision. If acting for an organization, you confirm authority to bind it. Do not register with another person's phone number, Apple account, or identity without authorization.
3. Account and security
Chupian supports phone-code login and may support Sign in with Apple. Keep codes, devices, and credentials secure. Tell us promptly about unauthorized access. We may verify, limit, freeze, or suspend activity reasonably believed to involve attacks, automated abuse, fraudulent credits, or account compromise.
You may request deletion in Profile — Settings — Delete Account. Deletion removes or anonymizes account data, server history, and unused entitlements except where retention is legally necessary. Deleting the account or app does not cancel an Apple auto-renewable subscription; you must cancel it in Apple's subscription settings.
4. How Chupian works
You may submit a complete original image, optional references, marks, quick prompts, text instructions, removal masks, and output settings. Screen zooming or cropping changes only the view, not the uploaded original. One task may combine retouching, removal, and sizing. Processing indicators are estimates, not guaranteed completion times. AI output can vary; inspect faces, hands, text, background, borders, and brands before saving, publishing, or commercial use.
Saving to Apple Photos requires permission. Refusing that permission does not prevent editing but prevents local saving. We may reasonably adjust supported formats, limits, providers, and routing without taking away an already purchased and unexpired core entitlement.
5. AI-processing authorization
To complete a task, you authorize us and necessary storage and AI service providers to process the selected photos, references, coordinates, masks, prompts, settings, and results. Before the first AI task, the app provides a prominent disclosure and asks for explicit consent. If you refuse, the AI function is unavailable.
We do not use your photos to train general-purpose AI models unless we separately explain that use and obtain separate consent. AI output may omit or change details and is not medical, beauty, legal, financial, or other professional advice. Do not use it for identity verification, document forgery, deception, or high-impact automated decisions.
6. Your content and intellectual property
You retain rights you lawfully hold in uploads, prompts, and results. You grant us a worldwide, non-exclusive, royalty-free license, sublicensable only to necessary providers, to upload, store, copy, convert, transmit, process, display, and deliver that content solely to provide and secure the service. The license ends when the content is deleted or the purpose ends, subject to legal retention, dispute, and short backup periods.
You confirm that you have all necessary copyright, portrait, privacy, trademark, and other permissions. Chupian's app, interface, branding, text, code, and service logic belong to the Company or their licensors.
7. Prohibited conduct
Do not use Chupian for unlawful, pornographic, violent, hateful, fraudulent, gambling, drug-related, exploitative, or child-harming content; unauthorized intimate or sensitive images; harassment, defamation, blackmail, impersonation, or deceptive deepfakes; forged documents or evidence; infringement; malware; system interference; automated abuse; bypassing payment or safety controls; selling accounts or entitlements; or conduct that violates Apple or applicable third-party terms. We may reject a task, remove content, restore or freeze credits, limit service, preserve evidence, or report conduct as legally appropriate.
8. Credits and failed tasks
One credit is deducted when each processing round is submitted. A round combining retouching, removal, and sizing costs one credit; continued retouching is a new round and costs another credit. If our server, network, queue, or model confirms failure without delivering a valid result, that credit is returned. If the server completes the task while your device is offline, the result remains in history and the task is not treated as failed.
The 1-month one-time pass expires 30 days after purchase and unused pass credits become zero. Subscription credits are issued per subscription period and do not roll over. Credits are not money, transferable property, or redeemable for cash.
9. Paid services
Available products may include a 1-month one-time pass, monthly auto-renewable subscription, and annual auto-renewable subscription. Apple displays and processes the final local price and transaction. Read the Paid Services and Auto-Renewable Subscription Terms before purchase. A minor must obtain guardian approval.
10. Privacy and international processing
We process personal data under the Chupian Privacy Policy. During the current transitional deployment, the principal servers, databases, and object storage are in mainland China and serve Hong Kong, Macao, Taiwan, Singapore, Japan, South Korea, and the United States. Necessary providers may process task data in other regions. If you do not agree to the transfer necessary for an AI task, do not submit it.
11. Availability, suspension, and termination
Maintenance, upgrades, networks, Apple, providers, law, security events, or force majeure may cause delay or interruption. We take reasonable recovery steps and aim to notify planned major maintenance. If an important paid service permanently ends, we will handle unfulfilled entitlements as required by law or these Terms. We may warn, limit, suspend, or terminate a material violator and provide a reasonable appeal path unless urgent risk or law prevents notice.
12. Disclaimers and liability
The service is provided as available. We use reasonable commercial efforts but do not guarantee that every AI result is exact, flawless, timely, or suitable for every subjective purpose. You are responsible for rights in uploads and for checking output before use.
To the extent permitted by law, we are not liable for indirect or consequential losses or events beyond reasonable control. Where liability may lawfully be limited, the Company's aggregate liability for a paid service will generally not exceed the amount you paid for the disputed service during the preceding 12 months. This does not exclude intentional or grossly negligent misconduct, personal injury, or non-waivable consumer rights.
13. Notices and complaints
We may send essential service, transaction, security, or agreement notices in the app, by page notice, push, SMS, or email. If you believe an account, task, or entitlement was handled incorrectly, send the relevant account identifier, explanation, and necessary evidence without sending passwords or verification codes.
14. Governing law
These Terms are governed by the laws of the Hong Kong Special Administrative Region, subject to mandatory consumer, privacy, or other protections in your location. The parties should first try to resolve disputes amicably; otherwise a competent court at the Company's registered location may hear the dispute unless mandatory law provides another forum. Invalidity of one provision does not invalidate the remainder.
